Dispute between the Largest Shareholders in the Egyptian Automotive & Trading Company (EATC) “Karim Al Naggar” against Some Shareholders and the Restoration of Commercial Agencies of the Company

EATC, most-owned by well-known businessman Karim Al Naggar, is one of the largest commercial agents of global automotive and German companies such as Skoda and Volkswagen”. The famous businessman has resorted to Dr. Mohamed Hamoda to resolve his dispute with the shareholders thereto, as Miyatco, the shareholder and the owner of a considerable number of shares, claimed to own 85% of the shares and the fictitious ownership of the businessman for the shares and it filed a case to transfer ownership of these shares before the Economic Court in 2014. Dr. Mohamed Hamoda was able to manage this case with wisdom, competence and experience and was able to obtain a final judgment after the specialty jurisdiction of the Economic Court to consider the case. Thereafter, Miyatco challenged this ruling before the Court of Cassation and requested to stay its execution in summary. At the hearing before the Court of Cassation, Dr. Hamoda was able to present his legal arguments before the Court of Cassation by means of an oral pleading in which he was able to obtain a judgment with the effect of dismissing the request of execution stay submitted by the litigant. Dr. Hamoda was able to obtain an enforceable judgment from the Administrative Court to stop proceeding the company file until rendering irrevocable judgment on cassations filed before the State Council. Through what Dr. Mohamed Hamoda obtained by the judgments, businessman Karim Al Naggar was able to retain the commercial agencies of the global automobile companies after threatening to lose it. Instead, he was able to win after fierce competition with other Egyptian companies with agencies of global automobile companies in addition to the agencies that he was able to keep thanks to the efforts of Dr. Mohamed Hamoda to obtain judgments in favor of the famous businessman Karim Al Naggar against his opponents.
