Dispute of IGI Real Estate Group owned by Al Shata Family with the New Urban Communities Authority (NUCA).
Al Shata family is one of the largest families that owns a group of commercial joint stock companies engaged in the fields of investment, import, export, building, construction and communications. The group includes elite of businessmen. Al Shata Group of Companies has entrusted Dr. Mohamed Hamoda, the most prominent lawyer in Egypt and the Arab world, to be its legal consultant in order to provide the group with all legal consultants and take judicial proceedings in various commercial and arbitration disputes with Egyptian and overseas companies. Dr. Mohamed Hamoda was able to obtain an arbitral award in the dispute between Ginza Company affiliated to Shata Group of Companies against Hassan Allam Contracting and he was able to obtain an enforceable judicial order by annotating the arbitral award with the executive wording in preparation for the implementation it compulsorily on the funds of Hassan Allam Contracting. Dr. Hamoda also managed to terminate the case of tax evasion, in which the Company's officials faced a charge with the punishment of imprisonment by holding several meetings with the officials of the Ministry of Finance and the Department of Combating Tax Evasion ended with the settlement of all tax disputes, reconciliation and drop the charges. Dr. Mohamed Hamoda is assigned to draft and prepare all international contracts and agreements concluded by Al Shata Group of Companies with international financial corporates and institutions. Dr. Hamoda was also able to put the dispute between Al Shata Group of Companies and the new Urban Communities Authority to an end, after Urban Communities Authority notified the Company with the cancellation of allocation of the allocated lands in 6th of October City and Sheikh Zayed. Therefore Dr. Hamoda immediately submitted urgent requests to the Minister of Investment and senior officials of the General Authority for Investment and Free Zones (GAFI). Several meetings were held to settle the dispute. Thanks to the efforts of Dr. Hamoda, the Company was able, to retain all the land allocated to the group for establishing major development projects such as outstanding Hay AL-Ashgar among other projects. Dr. Hamoda also managed to win the case filed by a foreign company against the Al Shata Group of Companies requesting declaring bankruptcy before the Economic Court and obtained a judgment with effect of dismissing the case, which enabled the Group to maintain its entity.
